Will this program affect my credit?
YES. While on the program we are not making regular monthly payments to your creditors. While saving for settlements, your accounts will fall past due, which has an effect on your payment history score. As the program progresses and we negotiate and pay each account, those accounts will be updated on your credit report to reflect a $0 balance. The goal of the settlement program is to reduce your unsecured outstanding debts to $0.
Can my creditors take me to court?
In some cases creditors may refer a past due account to a law firm for collections. This collection strategy is generally used to scare you into paying, but the lawyers they refer accounts to are often not licensed in the debtors state and therefore cannot proceed with any legal action. If one of your accounts is referred to a law firm in your area, we will still have the opportunity to negotiate a settlement or payment plan directly with the law firm. We will take every step possible and work with you closely to prevent any further action, but cannot guarantee your creditors will not seek judgment and post judgment remedies on your accounts. It is important to keep in mind that when a creditor does refer an account to a law firm for collection, their goal is to receive payment on the account, not proceed with further legal action unless the matter is ignored by the debtor.
Will creditors stop calling?
United Consumer Services, nor any other debt settlement company, can stop creditors from trying to contact you. For the first few months of the program you may still receive calls from your creditors inquiring about your accounts, but the calls will eventually decrease or stop altogether. We will notify the creditors that we are working on your behalf to resolve the situation and have all future creditor communications go through our office. If you should receive continuous calls, there are rights and laws to protect you.
Once your accounts have been referred to a third party collection agency, they must adhere to the Fair Debt Collection Practices Act (FDCPA). Some of the guidelines in this act include:
